Arthur Hellman on Constitutional Challenges to Health Care Law

Professor Arthur Hellman discussed the constitutionality of the new health care law – and particularly the personal mandate to buy health insurance – in an interview on KDKA radio. He said that the lawsuit filed by a group of state attorneys general is solidly grounded in the original understanding of the Constitution’s delineation of national government powers but that Supreme Court precedents, although distinguishable, can be invoked to support the validity of the mandate.
