Grading Details

The written exercises will be worth 70% of the grade. The oral negotiations and arguments will be worth 30%.

Description

The course will introduce various aspects of the U.S. international lawyer’s practice in an experiential learning context, and will consist of some traditional classroom work but will principally be devoted to negotiations, various drafting exercises, arbitration simulations, and other problems from current case law for arguing, assessing, and briefing. Reading topics and practical written or oral exercises will address, time permitting, current jurisdictional issues in international disputes, the Hague Convention on Evidence, foreign blocking statutes and U.S. discovery law, parallel proceedings, choice of law, recognition and enforcement of foreign judgments, the Foreign Sovereign Immunities Act and international arbitration.
