Deborah Brake

John E. Murray Faculty Scholar, Professor of Law

Prof. Deborah Brake is a John E. Murray Faculty Scholar and Professor of Law at the University of Pittsburgh, where she teaches Constitutional Law, Employment Discrimination, and Gender and the Law.  She is a nationally recognized scholar on gender equality and the law, with expertise in Title IX and athletics, sexual harassment and sexual violence, employment discrimination, pregnancy discrimination, and retaliation. She is a coauthor of the 8th edition of Gender and Law: Theory, Doctrine, Commentary (with Katharine T. Bartlett, Deborah L. Rhode, and Joanna L. Grossman; Wolters Kluwer, 2020). She is the author of Getting in the Game: Title IX and the Women’s Sports Revolution (NYU Press 2010), and her articles have been published in esteemed journals such as the Georgetown Law Journal, Minnesota Law Review, William and Mary Law Review, North Carolina Law Review, Indiana Law Journal, and the Harvard Journal of Law & Gender. Her article, Leveling Down: When Equality Makes Everyone Worse Off, was selected for the prestigious Yale/Stanford Junior Faculty Forum. Her scholarly work has twice been cited in U.S. Supreme Court opinions and she has testified before Congress in both the House and the Senate. Before going into academia, she was senior counsel at the National Women's Law Center. She is a graduate of Harvard Law School and Stanford University. Brake strives to connect her scholarship to practical legal problems. She recently coauthored a Supreme Court amicus curiae brief in Ledbetter v. Goodyear Tire & Rubber Co., in which the Supreme Court rejected a continuing violation rule for challenging ongoing pay discrimination, and testified before Congress in support of the Ledbetter Fair Pay Act to reverse that decision.

Before joining the faculty of the University of Pittsburgh, Brake was senior counsel at the National Women's Law Center in Washington, D.C. She is a graduate of Harvard Law School, magna cum laude, and Stanford University.
